This post will answer some frequently asked questions on the crime of having the wrong license plate on a motor vehicle.

What is attaching wrong plates to conceal identity?

Under Commonwealth law, it is a crime to attach the wrong license plates to a motor vehicle in order to conceal its identity. The law states:

“Any person who attaches or permits to be attached to a motor vehicle…a number plate assigned to another motor vehicle…with intent to conceal the identity of such motor vehicle…shall be punished…”

What does the government need to show to prove someone deliberately attached wrong plates?

In order to prove a defendant guilty of the offense of concealing an identity, the Commonwealth must prove the following three elements beyond a reasonable doubt:

  • That the defendant attached the license plate in question to a motor vehicle, or permitted it so
  • The license plate in question was not assigned by the Registry of Motor Vehicles to that particular vehicle
  • That the defendant attached the license plate in question with the intent to conceal the identity of that motor vehicle
