What does it mean to attach wrong plates to conceal identity?

Under Commonwealth law, it is a crime to attach the wrong license plates to a motor vehicle in order to conceal its identity. The law states:

“Any person who attaches or permits to be attached to a motor vehicle…a number plate assigned to another motor vehicle…with intent to conceal the identity of such motor vehicle…shall be punished…”

How does the Commonwealth prove a defendant guilty of the offense?

 In order to prove a defendant guilty of the offense of concealing an identity, the Commonwealth must prove the following three elements beyond a reasonable doubt (ALL):

  • That the defendant attached the license plate in question to a motor vehicle, or permitted it so
  • The license plate in question was not assigned by the Registry of Motor Vehicles to that particular vehicle
  • That the defendant attached the license plate in question with the intent to conceal the identity of that motor vehicle
