Client and his girlfriend were arguing in early morning hours in the street. Police were called and interviewed both parties. Girlfriend said she was punched in the face, but soon after denied it, and was consistent in her statement. At the time of trial, couple had since broken up. Despite that breakup, she again came to court and said a lie is a lie, that she would not say he did it, ever—because he did not, she claimed. The District Attorney dismissed the case.
RESULT: BOTH CHARGES DISMISSED AT TRIAL.

Hardworking father and veteran did the unthinkable--he sexually abused his daughter. Recognizing his crime, client honorably presented himself to the local police department to ask that he be held accountable. He was not under investigation, suspicion or in warrant status when he did so. The result was several indictment(s) which carry, in some instances, life sentences. This District Attorney assigned the case had recently requested life sentences for like situations (after trial). Attorney Barabino worked with all involved and, in the end, negotiated a sentence which was 10-12 years in prison and some probation afterward. This will allow defendant to be possibly released in the minimum time allowed by law for an aggravated rape offense, which is ten years. This was devastating for all involved—fortunately the victim is doing very well (but the effects of abuse can take years to show up). No more than mandatory minimum sentence of 10-12 years in state prison, with brief probation term after release.
RESULT: DEFENDANT ELIGIBLE FOR RELEASE AT MINIMUM MANDATORY DATE.

Client had been previously convicted of seriously abusing his girlfriend many decades ago. Now, once again, she accused him of the same crime. Client denied those new accusations, but also realized that based on his past conduct and the credible nature of the evidence, that a plea was preferable since it would mitigate the otherwise harsh sentence that the judge has proposed. However ultimately, the case went to trial. Client was convicted of all counts except threats to commit murder, for which he was found not guilty.
RESULT: Threat to Murder, NOT GUILTY.

Client was charged with malicious destruction of property under $250.00 and assault and battery on his girlfriend. In the early morning hours, police were called and an allegation was made of client punching a wall and, according to the accuser, also throwing a bottle at her, causing a mark (which was photographed). The case went to trial. At the day of trial, Attorney Barabino secured a very favorable deal, providing the defendant with no admission for any wronging or any probation or conditions.
RESULT: GENERALLY CONTINUED WITH NO ADMISSION OF WRONGDOING, & SECOND CHARGE DISMISSED ON $100 PENALTY

Mutual Combat, CHARGE DISMISSED

Client was hard working contractor. He was charged with assaulting and battering his houseguest. Charges were filed against both parties as even the police believed “mutual combat” had taken place. In the end, prior to starting the trial, the accuser failed to appear—resulting in a dismissal of the charge. Case dismissed.

Client was a hardworking federal employee. He was charged with Strangulation of his ex-girlfriend, Assault and Battery on his Girlfriend, and Assault and Battery on another involved in the incident in question. It was alleged that he was angry at his ex-girlfriend after discovering text messages from her former spouse on her phone. It was alleged that he came into her bedroom, pushed her friend into a dresser, and then proceeded to choke ex-girlfriend for nearly a minute. The district attorney applied for and received a Dangerous Hearing. Based on facts of the case, it was determined that client was too dangerous to be released into society. Attorney Barabino appealed that ruling and was successful. Client was then released pending trial. At trial, the jury ruled him not guilty of all the charges.
RESULT: 58A DANGEROUS HEARING OVERTURNED, Client released Pending Trial, NOT GUILTY OF ALL CHARGES.

Client was living with his mother and had a history of various criminal offenses. At one point client's step-father called police and filed a restraining order against him. When police interviewed the mother, she reported that the defendant had tried to strangle her two weeks prior. A Dangerous Hearing was held since the District Attorney believed defendant was too dangerous to be considered for bail. Attorney Barabino argued for release and was successful. The case moved to trial. At trial, the lack of available witnesses for the prosecution resulted in Attorney Barabino requesting and receiving a dismissal.
RESULT: RELEASED at Dangerousness Hearing 58A and ALL CHARGES DISMISSED AT TRIAL.

Client was married and accomplished professional with no prior record. A conviction or admission to charges of Assault and Battery With a Dangerous Weapon would have been catastrophic to his career path. After consultation with all parties, an agreement was reached invoking a marital privilege the day of trial. Case Dismissed, Restraining Order Vacated.

Client was a hard-working veteran and full-time US Army serviceman. He was charged with assaulting and battering his soon to be ex-wife. Conviction of such a crime would seriously threaten his military career. Fortunately, Attorney Barabino was able to cleverly find away around the charges. After an investigation, it was determined that the accuser appeared to have broken some laws. Attorney Barabino began the process for filing for a hearing to issue criminal charges against the accuser. The paperwork was filed and hearing was eventually held. At the conclusion of hearing, magistrate agreed with Attorney Barabino that charges should be filed against the accuser. A trial date was set but because charges were filed against accuser, she would incriminate herself if she testified. Both cases were consequently dismissed.
RESULT: Cross-complaint issued. Charges DISMISSED.

Client was a young man who was indicted on the above charges. The case involved a variety of legal issues and challenges to prepare the case for trial, which occurred over a two-year period. In addition to various discoveries, Attorney Barabino had physician expert on standby ready to testify for the defense. After four days of trial, the jury returned verdict of not guilty on all counts, with the exception of two misdemeanors.
RESULT: Jury Verdict: NOT-GUILTY OF ATTEMPTED MURDER, STALKING, INTIMIDATION OF A WITNESS, ASSAULT AND BATTERY AND ASSAULT WITH A DANGEROUS WEAPON.
