Client was a young electrician who was driving his car, lost control of the vehicle and collided with another vehicle, resulting in the other vehicle flipping over. Although no severe injuries the crash was certainly highly concerning to the court and police. The goal was to fashion a plea deal that would no directly affect his ability to drive to his employment. After discussion and negotiation with the District Attorney an agreement was struck whereby client would admit to sufficient facts, which would preserve his criminal record. Moreover, after that agreement was reached a further agreement was reached where the remaining civil infractions would be entered as a Not Responsible.
RESULT: Administrative Probation for One-Year, and all Civil Charges Not Responsible.

Client was a young man was out partying with two friends when all them of them got in a car accident. After the accident, fingers pointed in different directions as to who was the driver, or “operator”. In the end, after police arrested a person who the police incorrectly thought was the driver, the other two young men stepped forward and under oath stated that the defendant was not the driver. Despite those assertions, the case was required to process though several court hearings, with a trial date set. On day of trial, District Attorney, in good judgement simply dismissed the case as there would be insufficient evidence to move forward any longer and a dismissal was entered on both charges. Case Dismissed.
RESULT: Both charges, DISMISSED.

Client was a young man about to begin his first year of college. According to police, he was driving recklessly, passing cars and almost striking an officer. When police stopped him they were concerned that he was under the influence of an intoxicating substance. In addition to the facts witnessed by the police officer, client was disrespectful and verbally combative with the officer. In the end, to avoid a conviction on his record, client agreed to being on probation for 18-months, a driver safety course, and an evaluation to ensure that he is not abusing illicit drugs. If successful, the charge will be dismissed at the conclusion of 18-months. Additionally, his speeding fine and charge was found not responsible.
RESULT: DISMISSED, on condition client completes 18-month probation with conditions.

Hardworking mother was on probation for operating under the influence when she was charged again for the same offense. Probation violation triggered. Attorney Barabino and client rapidly addressed the probation violation at one court and received an agreement with Commonwealth that she add the SCRAMM alcohol monitor to her probation for the first case. The second case (new offense), placed on a disposition date (today), on which an agreement was made where the client would receive no jail time on the OUI charge and would agree instead to attend a two-week impatient program, the negligent operation charge dismissed, the highway wrong-way charge "not responsible", and open container of alcohol not responsible.
RESULT: NO JAIL TIME ON SECOND OFFENSE OUI, NEGLIGENT OPERATION DISMISSED, HIGHWAY VIOLATION AND OPEN CONTAINER VIOLATION NOT RESPONSIBLE.

A retired teacher was accused of negligently operating a motor vehicle. There were four separate witnesses, including a police officer that witnessed the motor vehicle crash. The witnesses were not helpful to the defendant. A plea was made before the judge asking for ninety-days probation. The District Attorney sought slightly more probation time. In the end, the judge sided with Attorney Barabino and allowed the defendant’s case to be dismissed, as long as she stays out of trouble, for a ninety-day period—otherwise called a continued without a finding or (CWOF).
RESULT: Case to be DISMISSED AFTER 90 DAYS, with NO CONVICTION ON RECORD. Enroll in two safety driver courses.

Client was stopped by police after hitting the fence of a police station. Police determined that the smell on his breath, unsteadiness and related factors were sufficient to arrest -assumption was correct. Client before had been drinking and was surprised to realize his level of intoxication was as high as it was. The biggest factor for client was accepting responsibility and getting a license back at the earliest possibility. Attorney Barabino and client were able to negotiate no jail time. Not responsible on Marked Lanes Violation. Negligent Operation Dismissed.

Super pleasant young man with great potential made a moment of bad judgment. According to police, in the early morning hours they noticed a vehicle made a civil infraction. They sought to pull the vehicle over but the driver refused. They followed the vehicle briefly. The vehicle was being driven negligently and after a brief pursuit came to a stop. Prior to arraignment, every effort was made to develop and demonstrate to the District Attorney the impressive background of the young man. In the end, an agreement was struck where he would not admit wrongdoing and the case would be dismissed in 90 days. This pre-trial probation term allows him to retain the presumption of innocence and a full dismissal of the charges.
RESULT: Case to be DISMISSED after 90 Days with NO ADMISSION OF WRONGDOING.

A smart, hard-working young computer engineer was charged with negligent operation of a motorcycle, speeding, and license suspension. According to police, she was traveling close to ninety miles an hour when she “goosed it” and tagged the back of a truck. Her pelvis, leg and shoulder were broken. After witnesses spoke to police, a determination that she was driving negligently was made and she was criminally cited. Also, because of her less than stellar driving record, a plea negotiation was agreed to where she would be required to take two driving courses and be on probation for a year with no attendance needed. Moreover, the plea allowed for her to take an “Alford Plea”, which means she didn’t admit she did anything wrong, important for her civil personal injury case. Also, no license loss as part of the agreement.
RESULT: ALFORD PLEA allows for rights preserved and NO ADMISSION OF WRONGDOING. NO LICENSE LOSS. CASE DISMISSED in a 12 months.

A young man had swerved off the road and struck a telephone pole. It was a single-car accident and police responded quickly and professionally. Client was transported to the hospital with injury. After two court dates and consultation with the District Attorney, a disposition was entered with the court. The result was an agreed upon dismissal in 90 days time. Also an entry of not-responsible was entered on Marked Lanes Violation as well -an otherwise additional small victory which prevented a surcharge and points against insurance.
RESULT: As long as Client remains arrest-free for ninety (90) days and enrolls in a half-day program called “Brains-at-Risk” this case to be DISMISSED. Client ADMITS TO NOTHING and still retains the PRESUMPTION OF INNOCENCE.

Client was a hardworking web-programmer. She was driving her motorcycle on the state highway in a reckless manner at speeds exceeding 100 mph. When pulled over by police, she immediately complied with officer order to stop, and was apologetic. Despite her apologies, the professional and respectful trooper issued her a criminal summons, and appropriately so. Based on a number of factors, including client’s background and history, Attorney Barabino’s request to have the criminal charge be stayed and not go forward if civil portion of the claim were paid was allowed.
RESULT: Application for Criminal Complaint, NOT ISSUED.
