Assault and Battery on a Person over 60
Client was an all-around relaxed dad when he was charged with felony assault and battery on a person over 60, a felony charge. Although, dad is a responsible and relaxed person he admittedly lost his cool. He had been driving when the person in front of him was driving erratically and at one point cut him off. Client pulled in and confronted the gentleman and eventually pushed him to the ground. That act was viewed by several credible witnesses. One of those witnesses who saw the event came to the aid of the person and assaulted client via punching him on the face. Eventually, client simply left and was interviewed by police and given a summons to appear in court for his arraignment. After nearly a year, a disposition was agreed upon by the district attorney whereby if client stays out of trouble for a year the case will be dismissed. Client also agreed to get anger management as well.
Result: Continued without a Finding for a One-Year Period at which time it will be Dismissed.
