Massachusetts Lawyers Weekly Reports on Attorney Barabino’s Landmark Case

Attorney Barabino served as counsel in Commonwealth v. Valerio DiGiambattista, a case that made its way to the Massachusetts Supreme Judicial Court. The case involved a legal dispute over voluntary confession. In the court’s final decision it ruled that for now on any unrecorded custodial interrogation of a defendant admitted into evidence entitles the defendant, on request, to a new jury instruction. Attorney Barabino’s historic work on this landmark case has changed the rules on criminal process and procedure in the Commonwealth.
